How Drake Contracting, Inc. Collects, uses, and protects your information.

1. Introduction

Drake Contracting ("Drake," "we," "our," or "us") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our website at drakecontracting.com (the "Site"), submit a contact form, request a quote or project consultation, apply for employment, or otherwise interact with us by phone, email, or in person.

We are a commercial general contractor serving clients primarily in the business-to-business space. This policy is written with reference to the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA/CPRA"). Even where statutory exemptions may apply, we provide California residents with the privacy choices described below as a matter of transparency and good business practice.

The following summary describes the categories of personal information we may collect, the purposes, whether each category is sold or shared, and how long it is retained. Full details appear in the sections that follow.

Identifiers (name, email, phone, address, IP, device IDs)

  • Purpose: respond to project inquiries, contact, employment applications, and operational communications.
  • Sold or shared? Not currently sold or shared for cross-context behavioral advertising. See Section 8.
  • Retention: see Retention section.

Project and business information

  • Purpose: prepare estimates, bid on projects, manage construction work.
  • Sold or shared? Not sold. Shared with subcontractors and project partners as needed to deliver projects.
  • Retention: project files retained for typical construction industry recordkeeping periods.

Employment application information (resume, work history, references)

  • Purpose: evaluate candidates for open positions.
  • Sold or shared? Not sold or shared outside the hiring process.
  • Retention: typically 2 years after the application is reviewed, unless you are hired.

Internet or network activity (browsing, page views, cookie data)

  • Purpose: site analytics through Google Analytics 4.
  • Sold or shared? Shared with Google Analytics if analytics cookies are accepted.
  • Retention: up to 26 months for analytics.

3. Categories of Personal Information We Collect

In the past 12 months, we have collected the following categories of personal information defined by California law:

  • Identifiers: name, email address, phone number, business name, mailing or job site address, IP address, online identifiers.
  • Professional or employment information: job history, references, resume content, and related employment application materials.
  • Commercial information: project inquiry details, scope of work, budget ranges, and project timelines.
  • Internet or network activity: browsing history on our Site, pages viewed, referring URLs, interaction with our content, and information collected through cookies.
  • Geolocation data: approximate location derived from IP address.

4. Sensitive Personal Information

We do not intentionally request Sensitive Personal Information through the Site. If our practices change, we will update this policy and offer the Right to Limit Use of Sensitive Personal Information.

5. Categories of Sources

  • Directly from you when you submit a contact form, request a quote, apply for employment, contact us by phone or email, or interact with us in person. Our website contact forms use your device's email client to send the contents directly to us; no third-party form-handling service stores submissions on our behalf.
  • Automatically from your device and browser when you visit the Site, through cookies, analytics, and server logs.
  • From our service providers, including analytics vendors.
  • From business partners, subcontractors, vendors, and references in the course of operating projects.

6. Business and Commercial Purposes for Collection

We use personal information to:

  • Respond to inquiries about projects, quotes, and consultations.
  • Manage construction projects, including communicating with clients, subcontractors, vendors, and partners.
  • Evaluate employment applications and conduct hiring.
  • Send occasional communications about Drake Contracting where you have opted in.
  • Improve our Site and services.
  • Detect and prevent fraud and protect Site security.
  • Comply with legal, tax, contracting, and licensing obligations.

7. Service Providers and Contractors

We disclose personal information to service providers and contractors who process information on our behalf and only for the purposes we direct. The list below is representative and not exhaustive. We may add, change, or replace providers from time to time, provided the new provider serves an equivalent purpose under similar confidentiality and security obligations. Examples of categories and current providers include:

  • Website hosting providers.
  • Cookie consent management providers, including Osano, or any similar consent platform we may use.
  • Email and communications platforms used to respond to inquiries and manage projects.
  • Analytics platforms, including Google Analytics 4, or any similar analytics platform we may use.
  • Project management, accounting, and operational software platforms used to run the business.

8. Third Parties and Advertising

We currently use Google Analytics 4 to understand how visitors use our Site. This service may collect anonymized usage data through cookies.

We do not currently sell personal information for monetary consideration. We do not currently run paid advertising campaigns that build remarketing audiences from our website visitors. If we engage in cross-context behavioral advertising or build remarketing audiences in the future, we will:

  • Update this Privacy Policy to reflect that activity.
  • Gate any such tracking through our cookie consent manager so visitors can opt in or out.
  • Provide a clearly labeled "Do Not Sell or Share My Personal Information" opt-out link in our website footer.
  • Honor Global Privacy Control (GPC) signals as automatic opt-out requests.

We may share information with subcontractors, project partners, vendors, professional advisors (accountants, attorneys), and government or licensing authorities when required by law, by subpoena or court order, or to protect our legal rights. We may also share information with successor entities in connection with a merger, acquisition, financing, or sale of assets.

9. Cookies and Tracking Technologies

Our Site uses cookies and similar technologies for the following purposes:

  • Strictly necessary cookies required for the Site to function, including consent preference storage.
  • Functional cookies that remember your preferences and improve performance.
  • Analytics cookies for Google Analytics 4 to help us understand Site usage.

We use the Osano Cookie Consent Manager to manage your cookie preferences. When you first visit our Site, you will see a consent banner. You can change your preferences at any time by clicking the Osano cookie icon on any page. We honor browser-level Global Privacy Control (GPC) signals as automatic opt-out requests where applicable.

Embedded Google Map. Our contact page embeds an interactive Google Map of our office location. Loading this map sets cookies from Google (including NID) and transmits your IP address and browser metadata to Google. The map loads only on our contact page and is not used to track your activity elsewhere on the site. Google's privacy policy applies to data Google receives through this embed.

Hosting platform tracking. Our website is hosted on a third-party hosting platform (GoDaddy) that automatically inserts a performance-monitoring script ("TCCL," loaded from secureserver.net and img1.wsimg.com) on every page served from this hosting environment. This script is added by the hosting provider after our website source code is published and before pages reach your browser; it is not part of our website source code and is not controlled by our cookie consent manager. We have asked the hosting provider about disabling or documenting this script. According to the script’s own instructional comment, opt-out requests must be directed to GoDaddy hosting support. We disclose this here for transparency. The script is present on every site hosted on the same platform.

10. Retention

We retain personal information only as long as needed for the purposes described in this policy, to comply with legal and business recordkeeping obligations, and to resolve disputes. Typical retention periods:

  • Project inquiry records: up to 3 years after the inquiry, longer if a project is awarded.
  • Project files: retained per construction industry recordkeeping practice, typically the term of the contract plus applicable statute of repose.
  • Employment applications: typically 2 years after review.
  • Communications records: as needed for business operations and legal compliance.
  • Site analytics: up to 26 months (Google Analytics default).
  • Server logs and security data: up to 12 months.

11. Your California Privacy Rights

If you are a California resident, you have the following rights under CCPA/CPRA:

  • Right to Know: request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we have shared the information.
  • Right to Delete: request that we delete personal information we have collected from you, subject to legal exceptions.
  • Right to Correct: request that we correct inaccurate personal information we hold about you.
  • Right to Opt Out of Sale or Sharing: direct us not to sell or share your personal information for cross-context behavioral advertising. As noted above, we do not currently engage in such activity.
  • Right to Data Portability: receive a copy of your personal information in a portable format.
  • Right to Non-Discrimination: we will not discriminate against you for exercising any of these rights.

12. How to Submit a Request

Contact us using one of the methods below:

We will verify your identity before responding to a request involving specific personal information. We will respond to verifiable requests within 45 days. If we need more time, we will notify you and may extend by an additional 45 days as permitted by law.

Authorized agents: you may designate an authorized agent to submit a request on your behalf. We will require the agent to provide written, signed authorization from you and verify your identity directly.

13. Children's Privacy

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will delete it.

14. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is fully secure, so we cannot guarantee absolute security. Notify us immediately if you suspect a security issue with your information.

15. Links to Third-Party Sites

Our Site may link to third-party websites and services. Their privacy practices are governed by their own privacy policies, not ours.

16. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page with a revised Last Updated date. Material changes will be communicated by a notice on our Site or by email where appropriate.

Do Not Sell or Share My Personal Information

California residents may opt out of the sale or sharing of personal information for cross-context behavioral advertising. As stated in Section 8, we do not currently sell or share personal information for these purposes. If we engage in such activity in the future, an opt-out mechanism will be made available through the cookie consent manager on our Site and through this policy. We also honor Global Privacy Control signals as opt-out requests for the browser or device sending the signal.
